📖 Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Veggies Cart ("Company," "we," "us," or "our"), governing your access to and use of the Veggie Cart mobile application and the website vegiesmart.com (collectively, the "Platform").

By downloading the app, creating an account, or using our Platform in any way, you confirm that:

• You have read and understood these Terms
• You agree to be bound by these Terms
• You are at least 18 years of age, or have parental/guardian consent
• You are accessing the Platform from within India

👤 User Eligibility & Account Registration

Age Requirement

You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that you meet this age requirement.

Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must promptly update your account information if it changes.
• You are responsible for all activities that occur under your account.
• You must notify us immediately at veggiecartapp@gmail.com of any unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Providing false information
• Fraudulent activity or abuse of the Platform
• Non-payment of dues
• Any reason we deem appropriate, at our sole discretion

🛒 Order Placement & Management

Placing Orders

• Orders can be placed through the Veggie Cart app or website.
• By placing an order, you make an offer to purchase the selected products at the listed prices.
• We reserve the right to accept or reject any order at our discretion.
• An order is confirmed only after you receive an order confirmation via push notification and email/SMS.
• Product availability is subject to real-time inventory and may change.

Order Cancellation

• You may cancel an order within 30 minutes of placing it, or before the order moves to "Packing" status, whichever is earlier.
• Once an order is in "Packing" or later stage, cancellation is not permitted.
• We may cancel orders if products become unavailable, prices are incorrectly listed, or there are concerns about fraud.
• If we cancel your order, you will receive a full refund within 3–7 business days.

Pricing

• All prices are listed in Indian Rupees (INR) and include applicable taxes.
• Prices are subject to change without prior notice.
• In case of pricing errors, we reserve the right to cancel the order and issue a full refund.
• Delivery charges (if applicable) are displayed at checkout before payment.

🚚 Delivery Terms

Delivery Area

Delivery Time Slots

• Morning Slot: 7:00 AM – 11:00 AM (orders must be placed before 11:00 PM previous day)
• Afternoon Slot: 12:00 PM – 4:00 PM (orders must be placed before 10:00 AM same day)
• Evening Slot: 5:00 PM – 9:00 PM (orders must be placed before 2:00 PM same day)
• Same-day delivery cutoff: Order placed before 12:00 PM noon.

Delivery Conditions

• Delivery is to the address provided at the time of order. We are not responsible for failed deliveries due to incorrect addresses.
• Someone must be present to receive the order. If unavailable, the delivery partner will attempt to leave the order safely or reschedule at our discretion.
• We are not responsible for delays caused by traffic, weather, or events beyond our control (force majeure).
• Delivery personnel are required to be polite and professional. Report any misconduct to us immediately.

Free Delivery

Free delivery is offered on orders above ₹299. Orders below this threshold attract a delivery fee of ₹25, displayed transparently at checkout.

💳 Payment Terms

• UPI (PhonePe, Google Pay, Paytm, BHIM, and all UPI apps)
• Credit Cards (Visa, Mastercard, American Express, RuPay)
• Debit Cards (Visa, Mastercard, Maestro, RuPay)
• Net Banking (all major Indian banks)
• Digital Wallets (Paytm, MobiKwik, Freecharge)
• Cash on Delivery (COD) for eligible orders

Payment Processing

• Online payments are processed securely by Razorpay, a PCI-DSS compliant payment gateway.
• We do not store your card details on our servers.
• COD orders require exact change. Delivery personnel do not carry change for large denominations.
• COD availability may be restricted for certain orders, areas, or users based on order history.

Failed Payments

If a payment fails, the order will not be confirmed. Any amount deducted will be automatically reversed to your payment source within 5–7 business days. Contact your bank or payment provider if the reversal does not occur.

Key Points

• Cancellations accepted within 30 minutes of order placement or before packing begins.
• Damaged, expired, or wrong items: report within 24 hours with photo evidence for a full refund.
• Refunds are processed within 3–7 business days to the original payment method.
• Perishable items (vegetables, fruits) cannot be returned once delivered in correct condition.
• COD orders: refunds are credited to your Veggies Cart wallet or via bank transfer.

🚫 Prohibited Activities

You agree not to engage in any of the following activities on our Platform:

• Creating false or duplicate accounts
• Placing fraudulent orders or providing false delivery addresses
• Using the Platform for any illegal purpose under Indian law
• Attempting to reverse-engineer, decompile, or hack the app
• Scraping, crawling, or automated data extraction without written permission
• Impersonating Veggies Cart staff, delivery personnel, or other users
• Posting false, defamatory, or misleading reviews
• Abusing promotional codes, referral programs, or cashback offers
• Interfering with the Platform's security or performance
• Harassing delivery personnel or customer support staff
• Reselling products purchased through our Platform without prior written consent

🌿 Product Quality & Accuracy

• We strive to display accurate product descriptions, images, and weights. Minor variations in fresh produce are natural and expected.
• Product availability is real-time and may change between browsing and checkout.
• Weights for produce items (vegetables, fruits) may vary by ±5% from the listed amount.
• We source from local farms and verified vendors but cannot guarantee complete uniformity in natural produce.
• Expiry dates for packaged goods are clearly labeled. We do not sell expired products.

⚠️ Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Our total liability to you for any claim shall not exceed the amount paid by you for the specific order giving rise to such claim.
• We are not responsible for losses due to force majeure events including natural disasters, strikes, government orders, or pandemics.
• We are not liable for the actions of third-party delivery partners, payment gateways, or vendors beyond our direct control.
• We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful components.

Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be excluded under applicable Indian law.

• All content on the Platform including logos, text, graphics, images, and software is owned by Veggies Cart and protected by Indian copyright and trademark law.
• You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.
• The "Veggies Cart" name, "Veggie Cart" app name, and our logo are trademarks of Veggies Cart.
• User-generated content (reviews, ratings) grants us a non-exclusive, royalty-free license to display such content on our Platform.

Our Platform may contain links to third-party websites or integrate with third-party services (Google Maps, payment gateways, etc.). These third parties have their own privacy policies and terms of service.

We are not responsible for the content, accuracy, or practices of any third-party websites or services. Use of third-party services is at your own risk.

⚖️ Governing Law & Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of India, including but not limited to:

• The Indian Contract Act, 1872
• The Consumer Protection Act, 2019
• The Information Technology Act, 2000
• The Digital Personal Data Protection Act, 2023

Jurisdiction

Dispute Resolution Process

• Step 1 — Informal Resolution: Contact us at veggiecartapp@gmail.com. We will attempt to resolve within 30 days.
• Step 2 — Consumer Forum: If unresolved, you may file a complaint with the District Consumer Disputes Redressal Commission, Tirupati.
• Step 3 — Arbitration: For disputes above ₹1,00,000, either party may opt for arbitration under the Arbitration and Conciliation Act, 1996, with proceedings in Tirupati.

Consumer Rights

Nothing in these Terms affects your rights as a consumer under the Consumer Protection Act, 2019 (India). You retain all statutory rights regardless of these Terms.

We reserve the right to modify these Terms at any time. Changes take effect when posted on this page.

• Material changes will be notified via push notification and email.
• The "Last Updated" date at the top will reflect the most recent revision.
• Continued use of the Platform after changes constitutes acceptance of the new Terms.
• If you disagree with updated Terms, you must stop using the Platform and may delete your account.
